Legislation Language Should Be in Accordance with the Language Criterion (Article written in chinese)

Abstract

As is known, the language in the standard legal amanuensis is generally called legislation language. It is one of the behavior criterions which are ascertained in the format of language and words. As soon as the standard legal amanuensis are confirmed and issued by the legislation departments, they will produce the legal effectiveness in judging people’s actions. Therefore all the contents in those documents should be conveyed in accordance with the general language criterion. Only in this way can they be easily understood and accepted by the people, and hence normal people’s behaviors. At present, on the whole, the various types of law and regulations issued in our country have paid attention to the preciseness and accuracy of language. However, there exist a great deal of unsatisfactory cases from the view of language standardization. A certain problems occur in the selection of words and phrases as well as in grammar logic or rhetoric in the legal documents. Some of the problems may blur the boundaries between crime and non-crime when the document is applied to a specific case. This paper points out some linguistic problems in The Criminal Law of the People’s Republic of China and The Criminal Procedural Law of the People’s Republic of China to be discussed with experts and other readers.
