A Study on the Verbal Interaction in Adversarial Courtroom Trial (Article written in Chinese)

Abstract

Courtroom discourse in adversarial trial system is in the form of statements and questions and responses. It is a dialogue among the judge, the procurators and defending lawyers. The purpose of the dialogue is to clarify the facts about the case being investigated and determination of the defendant’s motivation. During this process the courtroom discourse forms. This paper is devoted to the study of the context of courtroom interaction, the participants of the interaction, and the utterances of the interaction with a view to revealing the rules for justice and fairness in the interaction. The paper also explores the functional characteristics of questions in the interaction.
